What cannot be uploaded to HOTPIC.cc servers

Prohibited Content

Copyrighted images if you don't own the copyright and are not licensed to do so.
Violence, "hate speech" (i.e. demeaning race, gender, age, religious or sexual orientation, etc.), or advocacy against any individual, group, or organization.
Images that are threatening, harassing, defamatory, or that encourage violence or crime.
Any images that might be illegal in the USA or EU, such as child sexual abuse, or public exposure ("doxxing").

Important Notice

If you are not sure whether the image you want to upload is allowed then do not upload that image. Uploaded images are checked by staff and images that violate terms will be removed without prior warning. This may also get you banned from our website.

Automatic/programmatic uploads are not allowed. If you need image storage for your app, please use Amazon S3 or Google Cloud Storage. Violators may be hunted down and banned.

Image Attribution & Linking

Please keep the images embedded into third-party websites wrapped in links back to the corresponding HTML pages at our site when possible. The outgoing link should lead the user directly to our web page without any interstitial pages or interruptions. This allows your users to get access to the full-resolution images, and also helps us pay our bills.

User Rights & Content License

By uploading a file or other content or by making a comment, you represent and warrant to us that (1) doing so does not violate or infringe anyone else's rights; and (2) you created the file or other content you are uploading, or otherwise have sufficient intellectual property rights to upload the material consistent with these terms. With regard to any file or content you upload to the public portions of our site, you grant HOTPIC a non-exclusive, royalty-free, perpetual, irrevocable worldwide license (with sublicense and assignment rights) to use, to display online and in any present or future media, to create derivative works of, to allow downloads of, and/or distribute any such file or content.

User-Generated Content (UGC) Restrictions

By downloading an image or copying other user-generated content (UGC) from HOTPIC, you agree that you do not claim any rights to it. The following conditions apply:

You may use UGC for personal, non-commercial purposes
You may use UGC for anything that qualifies as fair use under copyright law, for example journalism, but please include an attribute ("HOTPIC" or "courtesy of HOTPIC") next to where it is displayed.
You may not use UGC for non-journalistic commercial purposes unless you are the copyright holder or have obtained proper licensing.
Your use of UGC is at your own risk. HOTPIC MAKES NO WARRANTIES OF NON-INFRINGEMENT.
You may not copy or use any portions of our site except within the limits of fair use.

DMCA Notifications

If you believe content on our site infringes your copyright, you may notify our DMCA agent with:

Identification of the copyrighted work (must be registered with the Copyright Office)
Identification of the infringing material with URL or location details
A statement of good faith belief that use is not authorized
A statement that the information is accurate under penalty of perjury
Your physical or electronic signature
Instructions on how to contact you (email, address, phone)

HOTPIC's services are provided on an "AS IS – WITH ALL FAULTS" basis. Your use of our service is entirely at your own risk. We do not guarantee the availability, reliability, or integrity of files on our servers.

HOTPIC DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING WARRANTIES OF FITNESS AND MERCHANTABILITY. HOTPIC HAS NO DUTY TO MONITOR CONTENT AND DOES NOT ASSUME RESPONSIBILITY FOR THE ACCURACY OR APPROPRIATENESS OF ANY CONTENT.

HOTPIC WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. NO CAUSE OF ACTION MAY BE BROUGHT MORE THAN ONE YEAR AFTER IT OCCURS.

User Indemnification

YOU WILL INDEMNIFY AND HOLD HOTPIC AND ALL OF ITS PERSONNEL HARMLESS FROM ALL LOSS, LIABILITY, CLAIMS, DAMAGES AND EXPENSES ARISING OUT OF OR RELATED TO YOUR VIOLATION OF THESE TERMS, YOUR INFRINGEMENT OF THIRD PARTY RIGHTS, AND ANY HARM CAUSED TO ANY THIRD PARTY AS A RESULT OF YOUR UPLOADING.
